Tightened COVID-19 Restrictions and the Implications on Construction Projects

Implications on Construction Projects

On 17 July 2021, the NSW Government tightened COVID restrictions for Greater Sydney including Central Coast, Blue Mountains, Wollongong and Shellharbour until 11:59pm 30 July 2021.

Among restrictions limiting movements on residents in the Fairfield, Canterbury-Bankstown and Liverpool Local Government Areas, the NSW Government has ordered a pause on construction in Greater Sydney.

From 12:01am on Monday 19 July 2021 until 30 July 2021, all construction and non-urgent maintenance, including cleaning services and repair work on residential premises is to be paused.

This pause during construction projects may have serious implications for principals and contractors.

We recommend both principals and contractors taking steps to review all current construction contracts and consider issuing the relevant notices for Extension of Time (EOT) and alike as soon as possible.

If you require any assistance or advice concerning the current restrictions and how it may affect you and/or your business, please contact our Dispute Resolution Partners, Aaran Johnson or Bharath Balasubramanian.
